Lasting Power of Attorney & Court of Protection Solicitors in London

Planning ahead can bring peace of mind. At Evalen Law Solicitors, we help individuals and families prepare for the future with expert legal advice on Lasting Powers of Attorney (LPAs) and Court of Protection applications. Our solicitors provide sensitive, clear guidance to ensure your wishes are respected and your affairs are protected.

Types of Lasting Powers of Attorney

You can create one or both types of LPA depending on your needs:

Property & Financial Affairs LPA

Allows your attorney(s) to:

  • Manage bank accounts and bills

  • Handle investments and pensions

  • Sell or manage property

This type of LPA can be used with your consent while you still have capacity or if you later lose capacity.

Health & Welfare LPA

Allows your attorney(s) to:

  • Make decisions about medical care and treatment

  • Decide on living arrangements and daily care

  • Consent to or refuse life-sustaining treatment

This LPA only comes into effect if you lose mental capacity.

Registering a Lasting Power of Attorney

To be valid, your LPA must be:

  • Signed by the donor, attorneys, and a witness

  • Certified by an independent person (a certificate provider)

  • Registered with the Office of the Public Guardian (OPG)

Registration can take up to 20 weeks. We recommend setting up your LPA early to avoid delays.

Why Make an LPA?

Creating an LPA gives you control over your future care and finances. It helps:

  • Avoid Court of Protection delays and costs

  • Ensure trusted people make decisions for you

  • Reduce stress and uncertainty for family members

  • Protect your interests in the event of illness, accident, or dementia

Without an LPA, loved ones may need to apply for a Deputyship Order, a longer, more costly legal process.

Court of Protection & Deputyship

If someone loses mental capacity without an LPA in place, their family or friends may need to apply to the Court of Protection to become their deputy. This process can be:

  • Time-consuming (taking up to 12 months)

  • Expensive, with court and supervision fees

  • Restrictive, as deputies must regularly report to the court

At Evalen Law, we assist with Deputyship applications, including advice on ongoing responsibilities and compliance.
